1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Alyssa Hill, doing business as Body-Led Living LLC (“I,” “me,” or “my”). I am a trauma-trained somatic practitioner and a managing member of Body-Led Living LLC, a Colorado limited liability company. By booking a session, accessing my website, using my booking platform, or otherwise engaging my services, you acknowledge that you have read, understood, and agree to be bound by these Terms, my Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you must not use my services.

I reserve the right to modify these Terms at any time. I will provide notice of material changes by posting updated Terms on my website and, where appropriate, by email notification. Your continued use of my services after such changes constitutes acceptance of the revised Terms.

2. Nature and Scope of Services

2.1 Description of Services

Body-Led Living LLC provides somatic healing services — body-oriented support designed to help regulate and support the nervous system. My sessions may include guided somatic exercises, breathwork, movement exploration, body awareness practices, nervous system education, and related body-oriented approaches. All sessions are conducted exclusively via Zoom video conferencing and are booked through my online booking platform.

2.2 About Me

I am a trauma-trained somatic practitioner. I work with the body to support nervous system regulation, resilience, and healing. My training and approach are rooted in somatic and trauma-informed practices. I operate as a sole practitioner — when you book with Body-Led Living LLC, you are working directly with me.

2.3 What My Services Are NOT

THIS IS A CRITICAL DISCLAIMER. PLEASE READ CAREFULLY. My somatic healing services are not and shall not be construed as any of the following:

  • Psychotherapy, counseling, or mental health treatment. I am not a licensed psychotherapist, psychologist, licensed professional counselor, licensed clinical social worker, or any other type of licensed mental health professional. I do not diagnose or treat mental health conditions.
  • Medical care, medical advice, or medical treatment. I am not a licensed physician, nurse, or any other type of licensed medical professional. I do not diagnose, treat, cure, or prevent any disease or medical condition.
  • Massage therapy or physical therapy. My sessions are conducted entirely via video conferencing. While I may suggest self-touch exercises such as placing a hand on your chest or belly, these are always optional and self-directed. I do not perform or provide physical therapy or massage therapy.
  • A substitute for professional medical or mental health care. My services are complementary and educational in nature and are not a replacement for the care of licensed healthcare providers.
  • Emergency or crisis intervention services. If you are experiencing a medical emergency, psychiatric crisis, or are in danger, please call 911, go to your nearest emergency room, or contact the 988 Suicide & Crisis Lifeline by dialing 988.

2.4 Client Acknowledgment

By engaging my services, you acknowledge and agree that:

  • You understand that I am a somatic practitioner, not a licensed therapist or medical professional
  • You understand that my services consist of somatic healing — body-oriented support to help regulate and support the nervous system — and are educational and supportive in nature
  • You are voluntarily participating in somatic healing sessions for personal development and wellbeing purposes
  • You are solely responsible for your own physical and mental health and for seeking appropriate professional care
  • You will consult with a qualified healthcare provider before making any changes to your medical treatment, medications, or healthcare regimen based on anything discussed in our sessions
  • You will inform me of any medical conditions, psychological diagnoses, medications, or physical limitations that may affect your ability to safely participate in somatic practices
  • Any results or benefits experienced from my services are not guaranteed and may vary from person to person

3. Eligibility

To use my services, you must be at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement. By booking a session, you represent and warrant that you meet these eligibility requirements. I do not knowingly provide services to minors without the consent and involvement of a parent or legal guardian, and I reserve the right to refuse or discontinue services at my discretion.

4. Booking, Scheduling, and Appointments

4.1 Booking Process

All sessions are booked through my online booking platform. By completing a booking, you are entering into a binding commitment for the scheduled session, subject to the cancellation and rescheduling policies below. I understand that life happens. If extenuating circumstances arise, please reach out — I handle each situation on a case-by-case basis and am always happy to have a conversation.

My cancellation policy is as follows:

  • All sessions are nonrefundable unless otherwise mutually agreed upon in writing.
  • More than 24 hours before your session: You may reschedule anytime through the booking platform. If you need to cancel, all cancellations require submission of a cancellation form and my approval. Once approved, a session credit will be issued to your account.
  • Within 24 hours of your session: Rescheduling is no longer available. You may submit a cancellation form, however cancellations made within 24 hours of your scheduled session are subject to forfeiture of that session. Credits will not be issued for cancellations made within this window unless otherwise agreed upon.
  • No-shows: A 10-minute grace period is observed. If you have not joined within 10 minutes of your scheduled start time, the session will be marked as a no-show and the full session fee will be forfeited unless otherwise agreed upon.
  • Packages: All package purchases are non-refundable unless otherwise mutually agreed upon. Unused sessions within a package cannot be exchanged for cash or partial refund. Individual sessions within a package follow the same cancellation, rescheduling, and no-show policies above. Packages do not expire.
  • Group Events and Workshops: All group event and workshop registrations are non-refundable and non-transferable. No cancellations, credits, or exchanges will be issued.
  • Cancellation by me: If I need to cancel or reschedule a session due to illness, emergency, or other unforeseen circumstances, I will notify you as soon as possible and offer to reschedule at no additional charge or grant a session credit toward a future appointment.

4.3 Rescheduling

You may reschedule a session at no additional charge if you provide at least 24 hours notice before the scheduled session. Rescheduling requests made with less notice are subject to the cancellation policy above.

4.4 Late Arrivals

Sessions begin at the scheduled time. If you arrive late, the session will still end at the originally scheduled time. The full session fee applies regardless of late arrival. I may, at my sole discretion, offer to extend the session, but I am not obligated to do so.

4.5 Practitioner Cancellation

If I need to cancel or reschedule a session due to illness, emergency, or other unforeseen circumstances, I will notify you as soon as possible and offer to reschedule at no additional charge or grant a session credit toward a future appointment.

5. Fees and Payment

5.1 Session Fees

Current session fees are listed on my website and booking platform. I reserve the right to change my fees at any time. Fee changes will not affect sessions that have already been booked and paid for.

5.2 Payment Terms

Payment is due at the time of booking unless otherwise agreed in writing. I accept payment through credit card, debit card, PayPal, etc., via my booking platform. All payments are processed by my third-party payment processor. I do not store your payment card information on my servers.

5.3 Taxes

Session fees are exclusive of any applicable taxes. You are responsible for any taxes, duties, or levies that may apply based on your location.

5.4 Refunds

Refunds are issued in accordance with the cancellation policy in Section 4.2 above. Refunds will be processed to the original payment method within 5-10 business days.

5.5 Disputed Charges

If you believe a charge is incorrect, please contact me at alyssa@bodyledliving.com within thirty (30) days of the charge. I will work with you in good faith to resolve any billing disputes.

6. Zoom Video Conferencing

6.1 Technology Requirements

My sessions are conducted via Zoom. You are responsible for ensuring that you have a stable internet connection, a device with a functioning camera and microphone, and a current version of the Zoom application or web client. I am not responsible for technical issues on your end that may affect session quality.

6.2 Session Environment

For the best experience and to maintain the safety of your session, I recommend that you join sessions from a private, quiet space where you feel comfortable and will not be interrupted. Because somatic healing work can bring up physical sensations and emotions, having a safe and private environment is especially important.

6.3 Recording

Individual sessions are not recorded by me unless I receive your explicit written consent in advance. Group events and workshops may be recorded for replay or educational purposes — if a group event will be recorded, you will be notified prior to registration. By registering for a recorded group event, you consent to the recording and understand that your participation (including video, audio, and chat contributions) may be captured.

Regardless of format, you agree that you will not record, screenshot, or otherwise capture any portion of a session, group event, or workshop without my express written permission. Unauthorized recording is a violation of these Terms and may be a violation of applicable law.

6.4 Zoom’s Terms

Your use of Zoom is subject to Zoom’s own Terms of Service and Privacy Policy. I am not responsible for Zoom’s data practices, and I encourage you to review Zoom’s policies.

7. Informed Consent and Assumption of Risk

7.1 Voluntary Participation

Your participation in somatic healing sessions is entirely voluntary. You may pause, modify, or stop any exercise or activity at any time during a session without judgment or consequence. I encourage you to communicate openly about what feels right for your body and nervous system.

7.2 Potential Risks

Body-oriented somatic practices may bring awareness to stored physical sensations, emotions, or memories as part of the process of supporting nervous system regulation. While this is a normal part of somatic healing work, you should be aware of the following potential experiences:

  • Temporary increases in emotional intensity, discomfort, or distress
  • Temporary physical sensations such as tingling, warmth, trembling, or fatigue
  • Surfacing of difficult emotions or memories
  • Temporary changes in mood, sleep patterns, or energy levels after sessions

These responses are often part of the nervous system’s natural process of regulation and release. However, they can feel unfamiliar or uncomfortable, and it is important that you are aware of these possibilities before beginning sessions.

7.3 Assumption of Risk

By engaging my services, you acknowledge these potential experiences and voluntarily assume full responsibility for any risks associated with your participation in somatic healing sessions. You agree to communicate openly with me about your experience during sessions, including any discomfort, so that I can adjust my approach as needed.

7.4 Right to Discontinue

Either party may discontinue the professional relationship at any time. If I believe that my services are not appropriate for your needs, or that you would benefit from a different type of professional support, I will communicate this to you and, where possible, provide referrals to appropriate professionals.

8. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information during intake and throughout our professional relationship
  • Inform me promptly of any changes to your health, medications, or circumstances that may affect your participation
  • Arrive on time for scheduled sessions and in a state where you can meaningfully participate (i.e., not under the influence of substances that impair your ability to engage safely)
  • Treat me with respect and courtesy
  • Follow the cancellation and rescheduling policies outlined in Section 4
  • Comply with all applicable laws in your jurisdiction regarding your use of my services
  • Maintain the confidentiality of session content and not share details about my proprietary methods, techniques, or materials

9. Confidentiality

9.1 My Commitment

I treat all information shared during sessions as confidential. I will not disclose your personal information or session content to any third party without your written consent, except as required by law or as described in my Privacy Policy.

9.2 Exceptions to Confidentiality

I may be required or permitted to disclose information without your consent in the following circumstances:

  • When required by law, court order, or subpoena
  • When there is a reasonable belief of imminent danger to you or another person
  • When there is a reasonable suspicion of abuse or neglect of a child, elder, or dependent adult
  • When consulting with supervisors or peer consultants, using de-identified information only

9.3 Important Note About Privilege

Because I am not a licensed therapist, counselor, or healthcare provider, our communications are generally not protected by therapist-client privilege, doctor-patient privilege, or similar legal protections that apply to licensed professionals. By engaging my services, you acknowledge and accept this distinction. If legal protection of your communications is important to you, I encourage you to discuss this concern with an attorney.

10. Intellectual Property

All content on my website, booking platform, and provided during sessions — including text, images, graphics, videos, audio recordings, exercises, guides, worksheets, educational materials, and my proprietary somatic methods — is my intellectual property and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any of my intellectual property for commercial purposes without my prior written consent. You are granted a limited, non-exclusive, non-transferable license to use materials provided during sessions for your own personal, non-commercial use only.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • No Warranties. My services are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. I expressly disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Limitation of Damages. In no event shall I be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, emotional distress, or loss of data, arising out of or related to your use of my services, even if I have been advised of the possibility of such damages.
  • Maximum Liability. My total aggregate liability for any claims arising out of or related to my services shall not exceed the total fees paid by you to me during the twelve (12) months immediately preceding the event giving rise to the claim.
  • No Liability for Third-Party Services. I am not liable for any acts, omissions, errors, or failures of third-party services, including Zoom, payment processors, or any other technology providers.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, my liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Alyssa Hill, doing business as Body-Led Living LLC, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:

  • Your use of my services
  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Any misrepresentation made by you
  • Any claim by a third party arising out of your actions or omissions

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to contact me at alyssa@bodyledliving.com and attempt to resolve the dispute informally for a period of at least thirty (30) days.

13.2 Mediation

If informal resolution is unsuccessful, you agree to participate in good faith mediation before a mutually agreed-upon mediator located in Arapahoe County, Colorado, before pursuing any other form of dispute resolution. The costs of mediation shall be shared equally between the parties.

13.3 Arbitration

If mediation is unsuccessful, any remaining dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in Arapahoe County, Colorado, and may be conducted via video conferencing if mutually agreed. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against me.

13.5 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court if the claim falls within the court’s jurisdiction.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of laws principles. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Arapahoe County, Colorado.

15. Termination

15.1 Termination by Client

You may terminate your use of my services at any time by providing written notice to me at alyssa@bodyledliving.com. Termination does not relieve you of any obligations to pay for sessions already completed or scheduled and subject to the cancellation policy.

15.2 Termination by Practitioner

I reserve the right to terminate or suspend my services to you at any time, with or without cause, and with reasonable notice where practicable. Reasons for termination may include, but are not limited to:

  • Violation of these Terms
  • Conduct that is abusive, threatening, or disrespectful
  • Failure to pay for services
  • My professional determination that my services are not appropriate for your needs
  • Any other reason at my professional discretion

15.3 Effect of Termination

Upon termination, your access to my booking platform may be deactivated. Provisions of these Terms that by their nature should survive termination (including Sections 10, 11, 12, 13, 14, and 17) shall survive termination.

16. Force Majeure

I shall not be liable for any delay or failure to perform my obligations under these Terms if such delay or failure results from circumstances beyond my reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or telecommunications failures, power outages, or other force majeure events. In such cases, I will make reasonable efforts to reschedule affected sessions.

17. General Provisions

17.1 Entire Agreement

These Terms, together with my Privacy Policy and any other documents referenced herein, constitute the entire agreement between you and me regarding your use of my services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17.3 Waiver

My failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by me to be effective.

17.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without my prior written consent. I may assign my rights and obligations under these Terms without your consent in connection with a sale of the business or by operation of law.

17.5 Notices

All notices required or permitted under these Terms shall be in writing and shall be sent to the contact information provided in these Terms. Notices to you may be sent to the email address associated with your booking account.

17.6 Headings

The section headings in these Terms are for convenience only and do not affect the interpretation of these Terms.

17.7 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights in any person or entity.
